Your data is handled with the same 360-degree security we apply to our web builds.
Information Collection The Company only collects data necessary to fulfill the Client's requests, such as information submitted through contact forms or Client Portal logins. We collect only what is needed, nothing more.
How We Use Your Data Information collected is used exclusively to respond to inquiries, deliver services, send project updates and invoices, and improve our website and offerings. The Company does not use Client data for unsolicited marketing.
Third-Party Services The Company utilizes secure, industry-trusted platforms and digital tools to deliver and manage services. We never sell, rent, or trade Client personal or business information to any third party under any circumstances.
Privacy & Compliance ApexWeb360 complies with the Texas Data Privacy and Security Act (TDPSA). We do not sell or share your personal information with third-party marketers. Terms of Service
By engaging with ApexWeb360, you agree to a partnership built on transparency and technical excellence.
Master Service Agreement All engagements between the Company and the Client are governed by our Master Service Agreement (MSA), which outlines the rights, responsibilities, and expectations for every client relationship. The MSA is provided and must be signed prior to commencement of any work.
Project Scope All digital builds, including Web Design and SEO/GEO strategies, are defined by a signed Statement of Work (SOW). Work will not commence until the SOW is reviewed and approved by both parties. Requests outside the agreed scope may be subject to additional fees at the Company's standard rate. The Company will notify the Client in writing before proceeding with any out-of-scope work.
Payment Terms Payment terms are specific to each SOW. Most engagements require a minimum 30% downpayment to initiate work, with remaining balances structured around project milestones as defined in the SOW. Monthly maintenance and optimization fees are billed on a recurring basis. The Company reserves the right to pause work on any project with outstanding balances beyond 14 days.
Design Review & Approval Once the initial design is finalized, the Company meets with the Client to review the work together, align on direction, and formally agree on next steps before proceeding to the final build. Client approval at this stage is required before work continues.
Service Terms & Intellectual Property All design concepts, mockups, and proposals created by the Company remain proprietary to ApexWeb360 until the website is officially published and final payment has been received in full. Upon receipt of final payment, full ownership of the website design and all custom content is transferred to the Client. The Company retains the right to showcase completed work in its portfolio and marketing materials unless the Client requests otherwise in writing.
Website Build & Optimization Every website build includes a light SEO and GEO schema structure built into the foundation. Active backlink integration is not included in the base build. Backlink building and advanced ranking strategies require the Client to agree to an Optimization Tier 2 through Tier 4, as these involve ongoing work and continuous monitoring.
Maintenance Commitment 360 Maintenance plans require a minimum 6-month commitment. Search engines and AI platforms require time to crawl, index, and reflect optimization progress in results. Meaningful improvements typically begin to surface between months 3 and 6. Early termination within the minimum period may be subject to terms outlined in the MSA.
Platform & Tools The Company builds and manages websites using industry-standard web platforms and digital tools. The Client is responsible for their own platform subscription, domain registration, and any third-party fees, which are not included in the Company's service fees. The Company is not liable for changes, outages, or policy updates made by any third-party provider.
Service Limitations While the Company utilizes industry-leading SEO and GEO practices, digital rankings are subject to third-party algorithm changes by Google, OpenAI, Bing, and other platforms. The Company commits to best-practice strategies and transparent reporting but cannot guarantee specific placement or results.
Termination Either party may terminate a service agreement with 30 days written notice. The Client is responsible for payment of all work completed up to the termination date. Deposits are non-refundable once work has commenced.

SEO & GEO Results The Company makes no guarantee of specific search engine rankings, traffic levels, or business outcomes. Rankings are subject to third-party algorithm changes at any time without notice. Results vary based on industry, competition, content quality, and other factors outside the Company's control. SEO and GEO optimization requires a minimum of 6 months before meaningful, measurable results can be expected.
Uptime & Platform Performance The Company is not liable for third-party hosting interruptions, outages, or service degradations beyond its direct control. The Company will communicate proactively in the event of a platform-level disruption.
Security The Company implements best-in-class security protocols across all websites it builds and maintains. However, the Client is responsible for maintaining strong password hygiene for all their individual access points. The Company is not liable for breaches resulting from the Client's failure to maintain secure credentials.
General Nothing on this website constitutes legal, financial, or professional advice. The Company recommends consulting qualified professionals for matters requiring legal or financial guidance.
Legal
Governing Law & Jurisdiction These terms, and any disputes arising from services provided by the Company, shall be governed by the laws of the State of Texas. Any legal proceedings shall be conducted in the appropriate courts of the State of Texas.
Limitation of Liability The Company's total liability in any matter arising from a Client engagement shall not exceed the total fees paid by the Client to the Company in the thirty (30) days immediately preceding the date of the claim.
Indemnification The Client agrees to indemnify and hold harmless the Company from any claims, damages, or expenses arising from the Client's misuse of deliverables, violation of these terms, or infringement of any third-party rights through content provided by the Client.
Severability If any provision of these terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Entire Agreement These terms, together with the signed Master Service Agreement and applicable Statement of Work, constitute the entire agreement between the Company and the Client and supersede all prior discussions or agreements.
